CALL TO ORDER / PRESENTATION OF MINUTES
- Duane Oord called the meeting to order at 7:04pm. Present were Duane Oord, Cheryl Carlson and Steve Yandl.
- Steve Yandl presented the minutes of the September 2011 board meeting. Cheryl Carlson moved to accept the minutes, Duane Oord seconded and the motion passed 3–0.
- Steve Yandl provided current financial status. Our long term reserve is at $44,793 and operational reserve is at $10,870. The balance in checking is $37,667 but after subtracting outstanding and just ordered checks we’re actually at $11,938. Subtracting anticipated expenses through the remainder of the year, it’s anticipated we’ll need to spend an additional $1400 from operational reserve plus whatever fence repairs need to be completed before the end of the year.
- Because we used funds from the long term reserve (CD) for legal expense, we owe the long term fund $41,719. This is the $9,880 planned contribution from 2011 assessments plus $31,839 actually pulled from the CD. By agreement at the September meeting, this amount will be replenished through special assessments for each of the next four years. Assuming a new reserve fund analysis doesn’t alter the amount needed in reserve, this would be an extra $42 per member ($10,430/year) for each of the next four years.
- On initial analysis of the budget, it appears the regular budget will be close to the 2011 and dues (regular) won’t likely need to increase more than $5 to $10, if at all. If and when a new reserve analysis is done, we may be able to adjust the planned special assessment up or down which will impact total dues collection over the next four years.
- Cheryl Carlson reported that she was able to find the hazardous alder tree discussed last meeting at 15914 67th Drive. It appears the tree is actually in NGPA belonging to Gold Creek 1 which limits what the HOA can do.
- Town and Country Fence was scheduled for October 5 to evaluate problem fence panels (14 panels identified by Cheryl) and provide a quote. Because of the current financial situation, Cheryl will discuss the bid with Steve Yandl before scheduling the repairs.
- Cheryl reported a problem in the sprinkler system along Snohomish Cascade Drive. She will contact Skinner to have it evaluated before they complete system shutdown and winterization.
- Skinner will be bringing the new contract (with no cost increase or other changes from the current contract) for Steve Yandl’s signature in the next several weeks.
- We discussed the flagpole request from Bill and Cindy Steenis. There was some apprehension regarding height and location but the approval needs to be given.
- There is a problem yard situation where the owner (at 6912 150th Place) mowed only after a previous warning but it appears a new warning needs to go out.
- The parking infractions noted resolved without any letters being sent out.
- Steve Yandl reported that the judgment had been paid in our trial vs. Aaron Guimont and a satisfaction of judgment has been filed by Aaron’s attorney. If we need a dismissal with prejudice, we could have Sherman Knight draft the document and Thom Graafstra would sign.
- Steve Yandl shared the terms of the settlement with Jason and Angela Warner as well as the confidentiality agreement between Warners and the HOA. Specific terms can be shared with our lawyers, the bookkeeper and auditor but generally the terms of the settlement are confidential.
- Steve Yandl made the motion that we change the date of the next meeting to November 8 (second Tuesday of the month rather than first Tuesday) one time only to accommodate several conflicts. In discussions with board members not present at the meeting, Bill Steenis, Nicole Klages, and Evan Adolf indicated the change would be acceptable. Cheryl Carlson seconded the motion and it passed 3-0.
- We discussed the written appeal from Jane Ryan Koler, attorney for Eugene Hayes regarding Mr. Hayes’s canvas patio cover. Steve Yandl had phoned Ms. Koler prior to the meeting and discussed her arguments, in particular, her contention that the statute of limitations for civil matters would make it difficult for the HOA to prevail in court if the matter went to trial. After discussion, Cheryl Carlson moved that we grant a variance to override the ACC’s decision and permit Mr. Hayes to retain his patio cover, provided that it is kept in good presentable condition, isn’t attached to the common area fence and the approval doesn’t extend to any future owner of the property. Steve Yandl seconded the motion and it passed 3-0. Steve Yandl will inform Ms. Koler of the decision by phone and in writing.
- Cheryl Carlson will discuss tree removal or trimming with several owners where trees are growing into the fence prior to fence repairs being done on those sections of damaged fence.
